Together with the HKPropel Terms and Conditions and the HKPropel Copyright Notice, this Privacy Policy governs your continued use of the HKPropel site, which is operated by Human Kinetics, Inc. (hereafter “HK”). If you do not agree with any aspect of this Privacy Policy or any aspect of the Terms and Conditions, you may not use HKPropel.

HK respects users’ privacy and recognizes the need to provide privacy protections with respect to personal information we may collect from students and other users of HKPropel. We support the Children’s Online Privacy Protection Act (COPPA) and take additional steps to protect children’s privacy as described below.

What We Collect

HK, its hosting partner, and its subsidiaries and other agents (collectively “HK” hereafter), recognize the importance of protecting the information gathered from users in the operation of HKPropel and take reasonable steps to maintain the security, integrity, and privacy of any information collected. Although HK employs reasonable measures in connection with the collection, storage, and disclosure of information through the website, you should be aware that the confidentiality of any communication or material transmitted to and from HK through this website or by email cannot be guaranteed. Therefore, HK is not responsible for the security of information transmitted via the Internet. By submitting your information to HKPropel you consent to the practices described herein.

Registration Process. Users may be registered for HKPropel either by their teachers or school administrators, or by entering an Access Code. For users under 18, the registration includes the user’s first name and a username and password; no student email address is required or requested. Teachers/administrators are instructed not to include the student’s last name or photograph. Parental consent or teacher consent in lieu of parental consent (as described below) is required for registration of any user under the age of 13.

Persistent Identifiers. When users interact with HKPropel, certain technical information may be automatically collected to make HKPropel more interesting and useful, to diagnose and respond to problems, and for purposes related to HK’s efforts to promote learning. This non-personal information may include users’ dates and times of visit, time spent on the content, device ID, type of browser used (e.g., Chrome, Firefox), the type of operating system used (e.g., the version of Windows or Mac OS), and the service provider from which users receive Internet access. The information is collected by using technologies such as cookies and other unique identifiers, and may be collected by us or by a third party service provider to HK, including the company that provides hosting services for HKPropel (see below).

Personal Information Limitation. We limit our collection of personal information from students and other users to no more than reasonably necessary to participate in HKPropel.

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). We may collect, use, store, and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity data may include first name, last name, username or similar identifier. See the “Registration Under a Pseudonym” section for details related to registering under an alias. We do not collect social security numbers.
  • Contact data may include billing address, delivery address, email address, and telephone numbers, if applicable.
  • Financial data includes payment details, if applicable.
  • Transaction data includes details about payments to and from you and other details of products and services you have purchased from us, if applicable.
  • Technical data includes internet protocol (IP) address, login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.
  • Profile data includes username and password, purchases or orders made by you, preferences, saved searches or articles, and identity data (as above).
  • Usage data includes information about how you use our website, products, and services.
  • Marketing and communications data includes your preferences in receiving marketing from us and our third parties and your communication preferences, if applicable.

We may also collect, use, and share aggregated data such as statistical or demographic data for any purpose. Aggregated data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect aggregated data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy notice.

We do not collect any special categories of personal data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sexual orientation, political opinions, trade union membership, and information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offenses. Exception: Some HK learning products may rely on users to input health- or fitness-related information for the purposes of illustrating or explaining a scientific principle related to health and wellness. In these cases, a user’s personal health data is never used by HK outside the context of the learning activity, nor shared outside the context of the learning activity.

If you fail to provide personal data: Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

Users should be aware that when they voluntarily disclose personally identifiable information (e.g., username, email address, phone number) on bulletin boards, on blogs, or in chat areas of the HKPropel site, or sites of any related companies or subsidiaries, that information, along with any substantive information disclosed in the user’s communication, can be collected and used by third parties who are not affiliated with HK. Although HK takes every precaution possible to protect your information, by choosing to post personal information in areas that are viewable to all site visitors, such as forums and blogs, you are doing so at your own risk. Posting personal information may result in unsolicited messages from other posters or third parties. Such activities are not facilitated by HK and are beyond our control.

Registration Under a Pseudonym

If you are a student using HKPropel as part of a required course adoption and you do not want to provide us with your name, you may register under an alias. This registration method will require you to create and open an email account under that alias with a third-party email service. Then when you register with HKPropel, you will do so by providing your alias and the email address associated with that alias. You will be required to accept this Privacy Policy and the HKPropel Terms and Conditions as part of the registration process, and be subject to all requirements thereof, just as if you had registered under your own name. Under no circumstances do you have the right to impersonate another student or user or to share an account with another student or user. If you use an alias, it is wholly your responsibility to inform your instructor of your alias so that he or she can access your work progress within HKPropel and associate your alias with your name as it appears in other school data.

How Data Is Collected

We use different methods to collect data from and about you.

Direct Interactions: You may give us your identity, contact, and financial data by filling in forms or by corresponding with us by post, phone, email, or otherwise. This includes personal data you provide when you:

  • apply for our products or services;
  • create an account on our website;
  • subscribe to our service, products, publications, or notifications;
  • request marketing be sent to you.

Cookies: Users should be aware that nonpersonal information and data may be automatically collected through the standard operation of HK’s Internet servers or through the use of "cookies." Cookies are small text files a website can use to recognize repeat users, facilitate the user’s ongoing access to and use of the site, and allow a site to track usage behavior and compile aggregate data that will allow content improvements and targeted advertising. Cookies are not programs that come onto a user’s system and damage files. Generally, cookies work by assigning a unique number to the user that has no meaning outside the assigning site. We may also receive technical data about you if you visit other websites employing our cookies. If a user does not want information collected through the use of cookies, there is a simple procedure in most browsers that allows the user to deny or accept the cookie feature; however, users should note that cookies may be necessary to provide the user with certain features available on this site. How We Use Your Information

HK reserves the right to contact a user regarding product orders, support issues, and other matters relevant to the underlying service and the information collected.

The information we collect may be used in the following ways:

  • To deliver our products and services to you, to notify you about changes to our service, and to allow you to access restricted areas of HKPropel. For example, to log in, a user must enter their username and password, which allows the user to access the products and services associated with their HKPropel account.
  • To provide an interactive online learning experience. For example, if a student closes HKPropel on one device and opens it on another, all of the student notes and highlights are saved and HKPropel will open on the last page that the student accessed.
  • To provide controlled interaction with teachers and peers. For example, teachers may set up private blogs that she or he monitors, or project groups.
  • To affiliate student activities with a class. For example, some learning products delivered in HKPropel allow a user to affiliate with an instructor’s specific class so that student progress can be tracked. Your use of a Class Enrollment Token constitutes your acceptance of this feature; you understand your instructor will be able to track your progress if you affiliate with a class.
  • To assess learning or improve content. For example, non-personal information, such as aggregate information about the pages visited, percentage of ebook read, or percentage of review questions answered, may be used by teachers to gauge student learning and understanding of the content. Aggregate data from all schools, such as number of users accessing each ebook product, time on page, or review questions answered, may be used by HK to improve current content or guide new content for students.
  • To allow teachers to access the work completed by their students. For example, homework scores, questions completed, reading completed, and other data related to student progress allows the teacher to assess student learning within the system.

HK reserves the right to perform statistical analyses of user behavior and characteristics in order to measure interest in and use of the various areas of HKPropel.

Users Under 13

Parental Consent Required: Children under the age of 13 must have parental consent before they can use HKPropel. During the registration process for a user under age 13, we require the email address of a parent or legal guardian to be captured in HKPropel. We use the parent or guardian’s email address to seek parental consent for the child’s registration and to explain what information we are collecting, how we plan to use it, how the parent can consent, and how the parent can revoke consent. We also provide a link to this Privacy Policy.

Upon request, a parent may review any personal information of his or her child collected by us, and may revoke consent for his or her child to participate in HKPropel at any time. Parents should contact us via email at HKPropelCustSer@hkusa.com to review or revoke consent for collection of his or her child’s personal information. We will delete the child’s registration and personal information and parental contact information upon request. A parent’s email address will not be used or disclosed for any purposes other than as described in this Privacy Policy.

Teacher Consent in Lieu of a Parent: With regard to school-based activities, teachers and school administrators are permitted under applicable law to act on behalf of parents to provide consent for the collection of personal information authorized by the school. Schools should always notify parents about participation of their children in these activities. HK may elect to use teacher or administrator consent in lieu of a parent if it determines that it is appropriate to do so.

HK does not use any information provided by schools, such as class rosters or other school-provided data, for targeted marketing purposes of any kind. We do not select or deliver ads to students within HKPropel, nor do we use parent emails for any marketing purpose.

Data Protection

The security, integrity, and confidentiality of personal information are extremely important to us. We have implemented measures to protect the information provided to or captured by us against unauthorized access and use. We use robust security measures to protect user information from loss, misuse, and alteration, and industry-standard practices such as encrypted communications, firewalls, and password protection systems to safeguard the confidentiality of personal information.

From time to time, we review our security procedures to consider appropriate new technology and methods. Please be aware, however, that no security measures are perfect or impenetrable. We will retain personal information for the length of time needed to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

Disclosure of Information

We do not disclose to third parties any student’s (including any child’s) personal information that we collect other than as follows, consistent with applicable law:

  • We may share information with our service providers, including our hosting service provider, that assist us in operating HKPropel or servicing users, and with HK’s customer and technical support team, who all agree to keep this information confidential.   • We may release account information when we believe that such release is reasonably necessary to enforce or apply our Terms and Conditions; to protect the rights, property, and safety of HK’s site, our users, or others; or to conform to the requirements of law or comply with governmental orders, court orders, or legal process served on us. If customers do not pay us for products ordered, we may submit their account information to a third-party collection agency.

Use of Email Addresses

HK does not rent, sell, exchange, or share HKPropel users’ email addresses, or parent email addresses, with third parties (i.e., any entity besides Human Kinetics, Inc., its service provider, and its subsidiaries or agents). Information or files emailed to HKPropel’s customer service or technical support team will not be used for internal marketing and sales purposes, or be sold or otherwise transferred to unaffiliated third parties.

Use of Postal Addresses

Postal address information will not be shared with third parties without your permission, or where expressly forbidden by local privacy acts or legislation. When HK shares your postal address information with a third party, your personal information will become permanently subject to the information use and sharing practices of the third party, and the third party will not be restricted by this Privacy Policy with respect to its use and further sharing of your personal information. Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality. We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Data Retention

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data, and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances you can ask us to delete your data: see Your Legal Rights below for further information. In some circumstances, we may anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

Under certain circumstances, you have rights under data protection laws in relation to your personal data. You have the right to:
  • Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
  • Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  • Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  • Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data's accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  • Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
  • Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you.
  • No fee usually required. You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request in these circumstances.
  • What we may need from you. We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request, to speed up our response.
  • Response time. When these requests are made, we will meet the request as promptly as we reasonably can. If your request is particularly complex or you have made a number of requests, we will notify you of an extended time needed to respond.

Opt Out Details

HK will not sell, trade, share, or rent the Personally Identifiable Information of HKPropel users to others. Upon request, HK will use reasonable efforts to allow users to update/correct personal information previously submitted which the user states is erroneous to the extent such activities will not compromise privacy or security interests. Also, upon a user’s request, HK will use commercially reasonable efforts to functionally delete the user and his or her personal information from its database. However, it may be impossible to delete a user’s entry without some residual information because of backups and records of deletions, and transactional information HK may be required to retain for a period of time to be in compliance with applicable laws. Note that deletion of all of a user’s personal information from HK’s systems will deny the user any subsequent access to the online content they have purchased from HK. Do Not Track Disclosure

HKPropel currently does not respond to Do Not Track signals.

Transfer of Personal Information to the United States: If you are located outside of the United States, your personal information will be transferred to and processed in the United States, which may not have the same level of data protection as the country in which you are located. We have taken appropriate safeguards to protect your Personal Information in accordance with applicable data protection law.

This website may include links to third-party websites, plug-ins, and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy notice of every website you visit.

Warning About Fraudulent Emails

We will never request your password or credit card information through email. This practice, frequently called "phishing," is an illegal practice designed to steal your personal information. If you receive an email that looks like it is from us asking you for your personal information, please do not respond and instead notify us immediately by email at HKPropelCustSer@hkusa.com.
