Agreement on USMCA Strikes Expanded Protections for Biologics

The United States-Mexico-Canada (USMCA) agreement replaces the North American Free Trade Agreement (NAFTA). The agreement provides biotechnological firms at least 10 years exclusivity for agricultural chemicals (double the current 5), and the industrial design protection period increases from the current 10 years to 15 years. However, the agreement does not expand IP protections for biologic pharmaceutical products, which were not covered under NAFTA, and advocates hoped would be covered by USMCA.

Another IP related provision extends the copyright length in Canada to life plus 70 years, and 75 years for sound recordings. This extension mirrors the Trans-Pacific Partnership agreement, To learn more about the  USMCA agreement, click here.

What To Know About The California Consumer Privacy Act

On January 1, 2020, the California Consumer Privacy Act (CCPA) went into effect setting standards for businesses that collect and share personal data. The new rules aim to give consumers the right to know what information is being collected about them, the right to access the data, to delete the data, to know who the data is being sold to, and to opt-out of the sales. The legislation follows Europe’s General Data Protection Regulations which US companies with European customers already must comply with. Privacy law experts expect some companies will extend the protections guaranteed by the CCPA to people in other states, rather than treating customers differently depending on where they live. New York and Nevada are also considering privacy bills. The CCPA also provides extra safety for minors by preventing businesses from selling the personal information of consumers under the age of 16 without authorization by the minor or their parents. If a business does not comply, it can face fines of up to $7,500 per violation. To learn more about the California Consumer Privacy Act, click here.
