ORDER: (ORAL) (Per the Hon'ble Sri Justice S.V.Bhatt)

         Heard Mr.K.Ashok Reddy for petitioners and P.Shiv Kumar, learned

Standing Counsel for respondent No.2.

On 04.09.2018, respondent No.2 issued notice against 3rd respondent under Sections 25 and 21 of the Water (Prevention and Control of Pollution) and the Air (Prevention and Control of Pollution) Acts respectively. Now, the complaint of petitioners is that though notice is issued, further action is not taken in accordance with law. The prayer is against the inaction of 2nd respondent in disposing of the enquiry pending in Notice No.SRCL-30/PCB/RO-RGM/CFE/2018-500 dated 04.09.2018.

Mr.Shiv Kumar, on instructions, submits that the enquiry initiated through notice dated 04.09.2018 would be enquired into after affording opportunity to petitioners and 3rd respondent and necessary orders for controlling or removal of smell nuisance will be considered and passed within a period of two weeks from the date of receipt of a copy of this order.

The writ petition is, accordingly, disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending, stand closed.
