petitioner.

respondents/State.

Learned counsel for the petitioner raises ground regarding validity of the order dated 13/04/2017 (Annexure A/1) passed by Sessions Court, Dist. Gwalior, whereby, the revision preferred by the petitioner has been dismissed on the ground that the petitioner has not challenged the order under Section 31-A of Air ( Prevention & Control of Pollution) Act, 1981 as well as ground that under the grab of closing down hot mixing plant, the respondents have virtually closed the residential and other commercial activities of the petitioner, which is contrary to the spirit of order dated 06/03/2017 passed by the SDM, Gwalior.

Learned counsel for the respondents seeks short date to seek instruction in respect of claim made by the petitioner.

As prayed, list this matter on 03/05/2017. A typed copy of this order be supplied free of cost to learned State counsel for its onward transmission.
