Shri A.K.Sethi, Senior counsel with Shri Chetan Jain, counsel for the respondents no. 2 and 5. Ms. Preeti Waghmare, counsel for respondent no.3. The petitioner has sought a direction that the slaughter house running at Nipania road in Khajrana village should be closed so that the people of residential localities and multi-storied buildings in the neighbourhood of the slaughter house can live peacefully free from foul smell and in hygienic conditions. It is conceded that such slaughter house has been closed as per the directions of M.P. Pollution Control Board on account of not obtaining consent under the Water(Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981.
After hearing the learned counsel for the parties, we find that no further directions are called for except to clarify that the said slaughter house shall not be permitted to run, except after obtaining consent under the aforesaid Acts, or any other applicable law. With the said direction and liberty, writ petition stands disposed of.
