This appeal was filed by the appellant praying to call for the records concerning the application for consent and to set aside the closure direction issued in the proceedings No. PCB/BNA/12/393 dated 02.06.2012 of the 3rd respondent, to direct the respondent authorities to inspect the poultry feed mixing unit of the appellant , collect samples, analyse the samples and to submit a report and to direct the respondent authorities to consider the consent application filed by the appellant and grant consent to the appellant as the appellant is having the benefit of deemed consent under Section 21(4) of the Air (Prevention, Control of Pollution) Act 1981 and Section 25(&) of the Water (Prevention and Control of Pollution)Act, 1974.
The appeal is posted for dismissal in view of the non- representation of the appellant or his counsel in the last two hearings. Even this day when the appeal is called, the appellant is absent and there is no representation for the appellant. Under the circumstances, the Tribunal has no other option but to dismiss the appeal for non-prosecution. No order as to costs.
