Mohan M. Shantanagoudar, Ag. CJ The petitioner sought for police protection against the private respondents on the ground that they are not permitting him to run his rubber processing unit, without any valid reason.
At the time of issuing notice to respondents 3 to 12, an interim order was granted by this Court on 6.4.2016 directing the 2nd respondent to ensure maintenance of law and order and also that no obstruction is caused to the functioning of the petitioner's unit by respondents 3 to 12 and their men.
2. Learned counsel for the petitioner submits that subsequent to passing of the interim order by this Court on 6.4.2016, respondents 3 to 12 and their men are not creating any obstruction in the running of the rubber processing unit by the petitioner. Thus, as of now, the petitioner has no grievance against them.
It is not in dispute that the petitioner is running the rubber processing unit with appropriate licence in his credit. W.P.(C) No.13501 of 2016 -: 2 :- Prima facie there is no violation of law as such by the petitioner for starting and running the said unit.
3. However, learned counsel for respondents 3 to 12 submits that the petitioner is running his unit without complying with the requisite provisions under the Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981.
If the allegation made by the learned counsel appearing for respondents 3 to 12 is true, then, it is open for them to take appropriate steps in accordance with law. If such steps are taken, the concerned authorities will conduct an enquiry and thereafter pass orders as per law.
With these observations, this writ petition is disposed of.
