A.K. SIKRI, C.J.: (Oral) Grievance of the petitioner, in this petition, is that respondent No.6 has set up an industry, i.e., cupola furnace unit under the name & style of M/s Rana Casting, Plot No.3677, Street No.8, Baba Deep Singh Nagar, which is situated in the Municipal Corporation limits of Ludhiana in the State of Punjab and it is a health hazard. It is further submitted that setting up of such unit is in violation of The Air (Prevention and Control of Pollution) Act, 1981. The petitioner has made representation/complaint in this behalf to the State Pollution Control Board. It is also mentioned in the petition that on receipt of this complaint, the State Pollution Control Board has issued notice to respondent No.6 under Section 31A of the said Act on 28.8.2012, directing the respondent No.6 to comply with the requirement of the Act.

Once action is initiated by the State Pollution Control Board itself on the complaint of the petitioner, it is not necessary to entertain the PIL at this stage. Suffice it to say that State Pollution Control Board shall determine as to whether the furnace unit of respondent No.6 is violating any of the provisions of the Act and if so, further action under the said Act shall be taken by the Board. The necessary action as per law shall be taken and proceedings concluded within three months from the date of receipt of copy of this order.
