The present criminal miscellaneous petition has been filed for quashing the order dated 20th May, 2011 passed by the Chief Judicial Magistrate, Dhanbad in CO Case No.42 of 2011, corresponding to TR No.200 of 2011, whereby the cognizance of offences under Sections 41 and 43 of the Water (Prevention and Control of Pollution) Act, 1974 has been taken against the petitioner and all proceedings subsequent thereto.

On perusal of the report submitted by the Judicial Magistrate, 1st Class, Dhanbad vide his letter no.25 dated 2nd February, 2019, it appears that CO Case No.42 of 2011, corresponding to T.R. No.200 of 2011 has already been disposed of vide judgment dated 18th April, 2015 by reasons of which the sole accused- Chandeshwar Prasad Sinha (petitioner herein) has been acquitted.

In view of the said fact, there is no reason to proceed further in the matter.

This petition is, accordingly, disposed of.
