It is stated in the application that this PIL filed against the pollution created by respondent No.8 has rendered infructuous, as the problems has been sorted out by the respondent No.8, so the petitioner may be permitted to withdraw this petition.
Shri P.K. Kaurav, learned Additional Advocate General for the State submits that for violation of provisions of Air (Prevention and Control of Pollution) Act, 1981, a complaint has been filed by the Madhya Pradesh Pollution Control Board, which is pending before the competent Court of jurisdiction.
The aforesaid statement of the State is taken on record. The petitioner prays for withdrawal of this petition because of solution of the problems. Thus, without commenting on the merits of the case, we allow the petitioner to withdraw this petition.
However, any action taken by the respondent No.5 or other authorities of the State against the pollution created by the respondent No.8 shall not be affected because of withdrawal of this petition.
The petition is dismissed as withdrawn with no order as to costs.
