In the present petition, the petitioner is challenging the orders dated 15.05.2015 (Annexures P-18 & P-19), passed by the Chief Environmental Engineer, Punjab Pollution Control Board.

Undisputedly, the petitioner have a remedy to challenge these orders by filing the appeal under the Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.

In view of the said fact, learned counsel for the petitioner wants to withdraw the present writ petition with liberty to file appeal against these orders before the Appellate Authority under the aforesaid Acts, with further NARESH KUMAR liberty to move an application for condonation of delay in filing the appeal. 2015.12.18 16:07 I attest to the accuracy and integrity of this document Chandigarh CWP No. 12538 of 2015 (O&M) -2- Dismissed as withdrawn with the aforesaid liberty. If any such appeal with an application for condonation of delay is filed by the petitioner within a period of 15 days from today, we hope that the Appellate Authority will consider and decide the same in accordance with law, on merits of the case.
