Heard Shri Rituraj Meena for the appellant. In this matter leave is granted and the appeal was slated for hearing as to admission.

Learned advocate appearing for the appellant board submitted that the point of defective sanction under section 49 of Water (Prevention & Control of Pollution) Act 1974 has been relied upon by the trial court as one of the grounds for acquittal as has been decided by the Apex Court in case of GUJARAT POLLUTION CONTROL BOARD Vs. NOCOSULF INDUSTRIES & EXPORTS PRIVATE LIMITED AND OTHERS, reported in (2009) 2 SCC 171.

Appeal is admitted. Office is directed to call for record & proceedings.
