2 29-06-2015 Heard learned counsels for the petitioner and the State.

Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379, 414, 420, 467, 471, 120B of the Indian Penal Code and Section 21 of The Air(Prevention and Control of Pollution) Act, 1981.

It is alleged that coal was being transferred from a truck to another D.C.M truck. The driver of both the trucks disclosed their names as Deodip Prasad Mahto and Sanjay Kumar who suggested the name of the petitioner as owner of D.C.M truck.

It is submitted by learned counsel for the petitioner that even assuming the accusation no offence is made out against the petitioner as he is simply the owner of the truck and if any illegality was found, it was made by the driver of the truck who was apprehended on the spot. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar(Ind.) P.S. Case No. 51 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
