(Per: HONOURABLE MR. JUSTICE V.N. SINHA) 2 01-08-2014 By filing this public interest litigation petitioner has invited the attention of the High Court towards illegal establishment of 278 brick-kilns in the district of Nalanda, not only contrary to the provisions of the Pollution Control Act, Bihar Miner Mineral Concession Rules, 1972 but also in flagrant violation of the order of the Single Judge of this Court dated 02.07.2008, passed in C.W.J.C. No. 13733 of 2006. In these circumstances, we were inclined to direct the authorities to appear before this Court but before proceeding in the matter further, we would like the State respondents to file counter affidavit in the matter within ten days from today.
Put up on 19.08.2014 under the same heading Patna High Court CWJC No.9293 of 2014 (2) dt.01-08-2014 2/2 maintaining its position. If by the adjourned date order stopping production of bricks in the illegally established brick-kilns is not produced, this Court will have no option but to direct the authorities concerned to appear before this Court.
