2 25-04-2018 Heard learned counsels for the petitioner and the State.
Petitioner apprehends arrest in connection with Barun P.S. Case No. 52 of 2018 registered for the offence punishable under sections 379, 411, 420/34 of the Indian Penal Code, section 4/40 of the Bihar Minor Mineral Concession Rules, 197 and section 15 of the Pollution Act, 1986.
Learned counsel appearing for the petitioner submits that petitioner is no way concerned with the alleged occurrence. As a matter of fact, petitioner is only the owner of the tractor in question which was allegedly used for carrying sand. Moreover, the tractor in question was being utilized by one Rajnikant Mishra for carrying sand on valid challans. Learned counsel has brought on record the aforesaid challans as Patna High Court Cr.Misc. No.24859 of 2018(2) dt.25-04-2018 2/2 Annexure-3 to the application. Petitioner is a man of clean antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 52 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
