This petition for writ is before us to have an appropriate writ, order or direction for respondents that M/S Khan Int Udyog, Village-Ram Chandra Karmahiya, Tehsil-Nichlaul, District-Mahrajganj to stop mining operations which is going in violation  of the provisions of Sections 21/22 of the Air (Prevention and Control of Pollution) Act, 1981, as amended from time to time.

The writ petition was earlier dismissed in default in the month of January, 2018 but also restored to its original number on 07.02.2018.

Today too, none is present to pursue this petition. 

It is brought to our notice by learned counsel appearing on behalf of U.P. Pollution Control Board that the Chief Pollution Officer, Circle 6 under communication dated 20.03.2018 closed M/S Khan Int Udyog Village-Ram Chandra Karmahiya, Tehsil-Nichlaul, District-Mahrajganj has issued specific instructions not to proceed with mining operations without having necessary approval from Pollution Control Board and Zila Paryavarniya Sanghat Nirdharan Pradhikaran.

As per the learned counsel, in view of the directions issued under communication aforesaid cause agitated to this petition for writ has become infructuous.

In view of the statement so given, writ petition stands disposed of.
