When the matter was called out, neither learned advocate for the applicant was present nor anybody was present on behalf of the respondent.

This is an application filed under section 5 of the Limitation Act, 1963 for condoning the delay of 8 days caused in preferring Revision Application No.290 of 1995 against the order of Learned Chief Meropolitan Magistrate, Ahmedabad, in Criminal Case No.701 of 1990 for offences punishable under section 39 of the Air (Prevention & Control of Pollution) Act.

Taking into consideration the averments made in paras 2 and 3 of this application, the application is allowed. The delay of 8 days caused in preferring the Revision Application is condoned. Rule is made absolute.
