2 09-05-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek pre-arrest bail in connection with Barun P.S. Case No.72 of 2018 registered for the offences under Sections 379, 411, 420 /34 of I.P.C. and 4/40 of M.M.C.R. and 15 of Prevention of Pollution Act.

Accusation is that acting upon a tip of secret information about illegal mining and carrying uncovered sand loaded on the truck and tractor, the informant,Mining Officer, along with others raided near Keshav More under Barun Police Station and seized seven tractors loaded with sands including trailor bearing Registration No.BR24 GA 2744 while driver of the said tractor succeeded in fleeing away.

Learned counsel appearing on behalf of the petitioners are the owner and the driver of the aforesaid tractor respectively having all required papers regarding the seized tractors. It is further submitted that the petitioners have no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioners above named, in the event of their arrest or surrender before the court below within six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the C.J.M., Aurangabad, in connection with Barun P.S. Case No. 72 of 2018 subject to the conditions as laid down under Section 438(2) Cr.P.C.
