2 11-06-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Barun P.S. Case No.69 of 2018 registered under Sections 379 and 420/34 of the Indian Penal Code besides Sections 4/40 of the (BMMCR) Bihar Minor Mineral Concession Rules, 1972 and Section 15 of the Pollution Act, 1986.
The accusation is of seizing 29 tractors, attached with trailers, including the tractor attached with trailer of the petitioner, which was parked just after unloading the illegal extracted sand.
Learned counsel for the petitioner submits that it would appear from the F.I.R. itself that the tractor of the Patna High Court Cr.Misc. No.30852 of 2018(2) dt.11-06-2018 2/2 petitioner attached with trailer was found empty, parked at the place of the occurrence, and due to leakage of the water from the trailor of the petitioner, attached with the tractor, suspicion has been arisen against the petitioner about unloading the illegal extracted sand. The petitioner has no criminal antecedent.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No.69 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
