CM No. 16133 of 2016 The civil miscellaneous application has been filed by the petitioner for disposing of the writ petition as infructuous as the appeal pending before the Appellate Authority that has been constituted under the Air (Prevention and Control of Pollution) Act, 1981 and the Water (Prevention and Control of Pollution) Act, 1974 has been decided by the Appellate Authority vide order dated 06.10.2016.

The Appellate Authority constituted under the Air Act and the Water Act, respectively has vide order dated 16.10.2016 decided the appeal.

In view of the order being passed, the learned counsel appearing for the petitioner submits that the present petition has been rendered infructuous and may be disposed of accordingly, so as to enable the petitioner to assail the order (Annexure P-1), if necessary.

For the reasons mentioned in the application, the same is allowed.
