IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 2411 of 2014 Rajesh Kumar Karmali @ Rajesh Karmali ...... ... Petitioner Versus The State of Jharkhand ..... ... Opposite Party -------- CORAM : HON'BLE MR. JUSTICE H. C. MISHRA ------ For the Petitioner : Mr. Atanu Banerjee, Advocate For the State : A.P.P. ------ 2/ 17.11.2014
Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is apprehending his arrest in connection with C.P. Case No. 30 of 2013, for the alleged offences under Sections 37, 38 and 39 of the Air (Prevention & Control of Pollution) Act, 1981.
From the complaint petition filed by the Regional Officer, Jharkhand State Pollution Control Board, it is apparent that the factory of the petitioner was found in production in spite of the fact that the closure notice was issued to the petitioner's factory by the Pollution Control Board.
In the facts of this case, I am not inclined to grant anticipatory bail to petitioner, Rajesh Kumar Karmali @ Rajesh Karmali. Accordingly, his prayer for anticipatory bail is rejected.
