SATISH KUMAR MITTAL, J. ( Oral ) The petitioner has filed appeal (Annexure P-2) under Section 31 of the Air (Prevention and Control of Pollution) Act, 1981 (hereinafter referred to as `the Act'), against the order dated 02.07.2015 (Annexure P-1) passed under Section 31-A of the Act. It is stated that the said appeal was filed on 26.08.2015, but till date, neither any hearing has been given to the petitioner, nor his application seeking stay of the said order has been considered.

In view of the aforesaid facts, after hearing learned counsel for the petitioner, without issuing notice of motion as it will un-necessary delay the matter, we dispose of this petition with a direction to the Appellate Authority to consider and decide the aforesaid appeal dated 26.08.2015 in DASS NAROTAM 2015.11.04 14:19 I attest to the accuracy and authenticity of this document CWP No. 23426 of 2015 -2- accordance with law, expeditiously, preferably within a period of one month from today. Till the decision of the appeal, no coercive action be taken against the petitioner on the basis of the aforesaid order dated 02.07.2015, which has been challenged in the appeal.
