The petitioner apprehends his arrest in Barun P.S. case No. 81 of 2019 registered under Section 379, 411, 420/34 of the IPC, u/s 4/40 of Bihar Minor Mineral Rules and Section 15 of Environment & Pollution Act.

The informant raided a place and seized seven vehicles laden with sands and alleged that they were loading sands from the bed of river.

The learned counsel for the petitioner submits that petitioner is driver of tractor bearing registration No. BR24GB- 3931. The petitioner is driver and on the order of his owner the petitioner get loaded the sands on the tractor and raid was conducted. The petitioner has no manner of concern with the loaded sand. The petitioner is driver and he was driving the Patna High Court CR. MISC. No.37973 of 2019(2) dt.21-06-2019 2/2 tractor on the order of his owner.

Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. case No. 81 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
