SANJAY KISHAN KAUL, CHIEF JUSTICE (ORAL) The dispute relates to the order dated 24.7.2013 issued under Section 33-A of the Water (Prevention and Control of Pollution) Act, 1974 and Section 31-A of the Air (Prevention and Control of Pollution) Act, 1981, directing closure.

The aforesaid order is an appealable order before the National Green Tribunal and taking into consideration that a specialized Tribunal has been formed for this purpose, it is appropriate that the grievance is agitated before the Tribunal.

We thus, dismiss the petition with liberty to the petitioner to approach the Tribunal for examining the case on merits.
