2 04-04-2019 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Barun P.S. Case No. 36 of 2019, registered for the offence under Sections 379, 411 and 420/34 of the Indian Penal Code, under Section 4/40 of the Bihar Mines and Minerals Concession Rules, 1972 and under Section 15 of the Prevention of Pollution Act, 1986.

Allegation has been made that the petitioner was carrying illegal sand in a truck and upon seeking Police Party, left the tractor there and fled away.

No.20922 of 2019(2) dt.04-04-2019 2/2 As the petitioner has no criminal antecedent, let the above-named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Baraun P.S. Case no. 36 of 2019 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
