3 22-04-2013 Heard learned counsel for the petitioner and the State.

The petitioner is apprehending arrest in a case registered for the offences punishable under sections 379, 406, 420 of the Indian Penal Code, section 21(A), 22, 37 of the Air Pollution Act, 25, 35 and 44 of Water (Prevention and Control of Pollution) Act, 1972 and 7/15 of the Environment Rule 1985 and also under section 4, 26 and 40 of the Bihar Mineral Concession Rule, 1972.

Accusation against the petitioner is that the petitioner was found running mobile brick kiln without paying taxes.

It is submitted by the learned counsel Patna High Court Cr.Misc. No.11882 of 2013 (3) dt.22-04-2013 for the petitioner that the petitioner is ready to make payment of the due taxes within a period of three months.

Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for a period of three months in the event of arrest or surrender before the learned court below within a period of twelve weeks from today on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Guraru P.S. Case No. 09 of 2013 subject to the conditions as laid down under section 438(2) Cr.P.C. The provisional bail of the petitioner will be confirmed by the learned court below if the petitioner makes payment of the due taxes etc. within the aforesaid time.
