2 04-06-2018 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in connection with Barun P.S. Case No. 85 of 2018 registered for the offence punishable under sections 379, 411, 420/34 of the Indian Penal Code, sections 4/40 of Bihar Mines and Minerals Concession Rules, 1972 and section 15 of Prevention of Pollution Act, 1986.

Learned counsel appearing for the petitioner submits that petitioner is the owner of the vehicle in question. All the tractors which were parked at the alleged place has been seized and their drivers and owners have been made accused alleging general and omnibus allegations. Petitioner has no criminal antecedent.

No.33398 of 2018(2) dt.04-06-2018 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 85 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
