13. C.R.M. 6621 of 2013 In the matter of: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 06.05.2013.

The petitioner, apprehending arrest in connection with Suti Police Station Case No.139 of 2013 dated 13.04.2013 under Section 37 of Air Prevention and Control of Pollution Act, 1981 have come to this Court for anticipatory bail. We have heard the learned Advocates for the parties and have considered the case diary. We do not think that there is any need for the custodial interrogation of the petitioner in this case. In these circumstances, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-(Rupees ten thousand) with one surety of like amount to the satisfaction of the Court concerned subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and with the further condition that the petitioner shall not operate the brick field till he receives the No Objection Certificate issued by the W.B. Pollution Control Board under the Air Prevention and Control of Pollution Act, 1981. The application for anticipatory bail is, thus, disposed of.
