Heard the learned counsel for the petitioner and the learned counsel for the State.

This is an application for anticipatory bail flied by the petitioner in connection with Ormanjhi PS case No. 14 of 2013 for the offence registered under sections 54, 67 of the Jharkhand Minerals Rules, 2004 and sections 33/41/42 of the Indian Forest Act and section 37 of the Pollution Control & Prohibition Act, 1981.

Petitioner has been prosecuted for running a crusher unit without having no objection certificate from Jharkhand State Pollution Control Board and he was indulged in collecting stones extracted through illegal mining from reserve forest.

It is submitted that not a single stone has been seized from possession of the petitioner in connection with this case. He had not been running crusher at the relevant point of time.

Learned counsel for the State has opposed the prayer. Considering above aspects of the matter, the petitioner above named is directed to appear/surrender before the court below within a period of three weeks positively from the date of this order and on his surrender, he shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Ranchi, in connection with Ormanjhi PS case No. 14 of 2013 ( GR No. 621 of 2013), subject to the conditions laid down under section 438(2) Cr.P.C.
