2 08-05-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in a case registered under Sections 379, 411 and 420/34 of the Indian Penal Code, Sections 4/40 of the BMMCR and Section 15 of the Pollution Act.
Three trucks were found indulged in illegal mining. Drivers of the two of the trucks managed to escape while driver of third one namely Narendra Pandey was apprehended and aforesaid illegal sand laden trucks were seized by the informant.
It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid Patna High Court CR. MISC. No.30369 of 2019(2) dt.08-05-2019 2/2 occurrence. He has been falsely implicated in the case. He happens to be owner of the one of the trucks seized by the informant and he had no knowledge of loading of illegal sand on his truck by its driver. He has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Barun P.S. Case No. 56 of 2019, G.R. No. 423 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
