AG, Punjab Ms. Diya Sodhi, Advocate for respondent no.2 Mr. Chetan Mittal, Sr. Advocate with Mr. Vivek Singla and Mr. Lalit Sood, Advocates for respondents no. 3 MAHESH GROVER, J.(ORAL) Learned counsel for respondent no.2 states that the petitioner has shifted over to a high speed boiler which is functioning and is giving satisfactory results.
In view of the above, when petitioner has become compliant, it is liberated from the consequences of the impugned order. However, it is made clear that if the Pollution Control Board finds any violation under the Air (Prevention and Control of Pollution) Act, 1981 it would be at liberty to initiate fresh action against the petitioner. We also make it clear that this is an interim arrangement as the petitioner has to finally shift to CNG boiler, a 1 of 2 ::: Downloaded on - 14-05-2018 14:03:22 ::: CWP no.1715 of 2018 (O&M) 2 change to which he has bound himself to and abide within a period of 3 months i.e by 1st July, 2018.
In view of above, instant petition stands disposed of.
