HON'BLE MR. JUSTICE VEERENDR SINGH SIRADHANA Order 01/06/2019 It is contended that the validity of the required consent is valid with effect from 23rd June, 2016 to 31st May, 2019, in the case at hand. Further, in case, an application for renewal of consent under Air/Water Act, is submitted by the lessee at least 90 days prior to its expiry and the matter of consent is not determined by the Board within the stipulated time period, the (Downloaded on 22/09/2019 at 12:12:04 AM) (2 of 2) [CW-9957/2019] Mines Department is not to stop issuance of Ravanna to the Mining Units.

Moreover, in the face of text of Section 25(7) of the Water (Prevention and Control of Pollution) Act, 1974; there shall be a deemed consent on expiry of a period of four months of making of the application.

Heard and considered.

Issue notice on writ as well as on stay application, returnable on 9th July, 2019.

Learned counsel for the petitioner would deposit process fee and take out notice for service on the non-petitioners.

Steps be taken within a week.

In the meanwhile, respondents are directed to issue Ravanna to the petitioner, if otherwise eligible.
