The petitioner which is an association of Nursing Homes and Hospitals in Gwalior, has assailed the show cause notice issued vide P-1 seeking explanation from it's members ,as to why action be not taken under the Bio Medical Waste (Management and Handling) Rules 1998 for non-establishment of Effluent Treatment Plant.
After arguing for sometime, learned counsel for the petitioner seeks to withdraw this petition with liberty to pursue the remedy of reply filed pursuant to the impugned show cause notice with direction that the competent authority i.e. the respondent no.2 who has issued the impugned show cause notice shall consider each and every aspect of the reply filed by the members of the petitioner before passing the order, after taking into account the provisions of the Water (Prevention and Control of Pollution) Act 1974, Air(Prevention and Control of Pollution) Act 1981 and also the Bio Medical Waste Management Rules 2016 which have come into effect from 28.03.2016.
With the above said liberty and without commenting upon merits of the matter, the present petition stands dismissed as withdrawn.
