Learned counsel for the petitioner seeks permission to make necessary correction in para 13 of the bail application.

Permission accorded.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with the case registered under Sections 414/34 of the Indian Penal Code, Section 30(ii) of the Coal Mines Act and Section 33 of the Indian Forest Act and Section 21 of the M.M.D.R. Act and Section 21/37 of the Air Pollution Act and Section 25/26/44 of the Water Pollution and Control Act.

Learned counsel for the petitioner has submitted that petitioner is quite innocent and have committed no offence.

Learned A.P.P has opposed the prayer for anticipatory bail. In the fact and circumstances of the case, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Hazaribag in connection with Barkagaon P.S. Case No. 67 of 2016 corresponding to G.R. No. 675 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, and subject to the further condition that on the date of surrender petitioner shall deposit Rs. 1,500/- in the trial Court.

The aforesaid deposit is subject to the result of the case.
