The appellant has sought the certified copies of Effects on Human Health for Drinking Water Quality of class D and Class E.
Grounds for Second Appeal The CPIO did not provide the desired information.
1Submissions made by Appellant and Respondent during Hearing: The appellant submitted that he is not satisfied with the reply of the CPIO. The CPIO submitted that an apt reply was provided vide letter 08.06.2018. On a query by the Commission as to what information he actually wants, he expressed his grievance relating to some information available on the website of the respondent. However, he could not justify his second appeal. The CPIO further submitted that CPCB monitors aquatic water bodies for their quality and information sought by the applicant is not available with them. Observations:
Based on a perusal of the record, it is noted that the following reply was provided:
"To fulfil the mandate of Water (Prevention & Control of Pollution) Act, 1974, CPCB implements a Nationwide Programme under National Water Quality monitoring Programme (NWMP) for monitoring of aquatic resources including Rivers however Drinking Water does not fall under the purview of CPCB and no study on effects on Human Health for drinking water quality under Class D & E has been done by CPCB. If any information relating to water quality of aquatic resources is required, you may please write to CPIO, WQM-I Division in CPCB."
It is pertinent to mention here that despite the vague and incomplete query asked by the appellant, the CPIO gave a categorical reply as per the RTI application stating that no study on the effects on Human Health for drinking water quality under Class D & E has been done by CPCB and therefore no such report is available.
Decision:
In view of the above observations, the Commission finds no infirmity in the CPIO's reply and hence, no further action is required in the present case.
The appeal is disposed of accordingly.
