The sole petitioner Shatrughan Prasad Singh @ Shatrughan Singh has moved this Court for grant of privilege of anticipatory bail in connection with Hunterganj P.S. Case No. 130 of 2015, instituted under Sections 379 of the Indian Penal Code and also under Section 21 MMDR Act, 2007, Section 21 of the Air Pollution Control and Prevention Act, Section 54 of the Jharkhand Mines Minerals Concession Rules, 2004 and Section 8 of the Jharkhand Mineral Sales Act, 2007.
Heard learned counsel for the petitioner and learned counsel representing the State.
The prosecution case relates to illegal mining of stones. Learned counsel appearing for the petitioner submitted that the petitioner is a licencee granted by the Department of Mines and Minerals and licence has also be granted under the Water ( Prevention and Control of Pollution) Act, 1974. Hence the petitioner had the right to store stones.
Learned Counsel representing the State has no serious objection. Considering the submissions of the counsels, facts of case and counter case and the allegation, I am inclined to grant the privilege of anticipatory bail to the sole petitioner, Shatrughan Prasad Singh @ Shatrughan Singh in the event of his arrest or surrender within a period of two weeks from the date of this order and shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Chatra in connection with Hunterganj P.S. Case No. 130 of 2015 ( G. R. No. 1096 of 2015) subject to the conditions laid down under section 438 (2) Cr. P.C.
