Learned counsel for the respondent/Board submits that his name has not been reflected in the cause list, therefore, he prays for time.

The Co-ordinate Bench of this Court in case of M.Cr.C.

No.22745/2016 under the Water (Prevention and Control of Pollution Act, 1974) in relation to Khasra Nos.372, 495, 496 and 497 admeasuring 26.002 hectare, situated at Village Pratappur, Tehsil Sihora, District Jabalpur passed on 09.05.2018, whereby the Criminal Complaint Case No.681/2012 filed by the Board against the applicant M/s. Anand Mining Corporation Vs. M.P. Pollution Control Board has been quashed.

It is contended that Board has filed another complaint against the applicant/Company under the Environmental Protection Act, 1986 with regard to Khasra Nos. 372, 495, 496 and 497 situated at Village Pratappur, Tehsil Sihora. Though, Khasra numbers have not been mentioned in the complaint and its partners have been arrayed in M.Cr.C. No.22745/2016.

Keeping in view the order dated 09.05.2018 passed in M.Cr.C. No.22745/2016, further proceedings of Criminal Case No.1205/2012 (Special Case No.29/2018) pending before the JMFC, 21st ADJ, Bhopal shall remain stayed only for two weeks.

List after two weeks.
