Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with the case registered under Sections 414/34 of the Indian Penal Code and 3/8 J.M.M.C. Rule 2004 4/54 Jharkhand Minor Minerals Concessions Rule 2004 & 21 Air Pollution Act 1981.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case. The entire allegation levelled against the petitioner is false and fabricated as no Khata number and Plot number mentioned in the written report given by the informant. It is further submidtted that the petitioner having no criminal antecedent.

Learned counsel for the State has opposed the prayer for anticipatory bail.

Be that as it may, I am inclined to admit the petitioner on anticipatory bail. The petitioner is directed to surrender in the court below within three weeks and in the event of his arrest or surrender, the court below shall release him on bail on his furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M, Seraikella, in connection with Chandil P.S. Case No.149/2016, Corresponding to G.R. Case No. 831/2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. Subject to further condition that on the date of surrender, petitioner shall deposit Rs. 5,000/- in the court below.

The aforesaid deposit is subject to the result of the case.
