2 26-03-2019 Heard the learned counsel for the petitioner and the State.

The petitioner seeks bail in anticipation of his arrest in connection with Barun P. S. Case No. 220 of 2018 dated 21.11.2018 instituted for the offences under Sections 379, 420 and 34 of the Indian Penal Code and Sections 4/40 B.M.R.C. & 15 Pollution Act.

The petitioner happens to be the owner of the loader which was being used for loading sand unauthorizedly on a truck. The driver of the vehicle has been granted anticipatory bail as informed by the learned advocate appearing for the petitioner.

No.15572 of 2019(2) dt.26-03-2019 2/2 Considering the fact that the petitioner is the owner of the loader and had given instructions to his driver not to use the aforesaid loader for any unauthorized purpose, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Barun P. S. Case No. 220 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
