Petitioners are apprehending their arrest in connection with Sikidiri P.S. Case No. 11 of 2017, corresponding to G.R. No. 1206 of 2017, registered under Section 379 of the I.P.C., Section 21 (1) / 21 (6) of Mines and Minerals (Development and Regulation) Act, 1957 and Section 4 (54) Jharkhand Minor Minerals Concession Rule, 2004 and Sections 21(A), 37 of Prevention of Control of Air Pollution Act.
Learned counsel for the petitioners submitted that petitioners were the owner of the one of the crusher but the same has been closed due to non-grant of licence and environment clearances since long, but the informant has raided the same and register the case showing stock of stone chips and stone dust which was actually less in quantity and kept since long due to closure of mines. It is further submitted that one of the co-accused has already been admitted on anticipatory bail vide order 28.08.2018 in A.B.A. No. 4920 of 2018 by this Court.
Learned APP has opposed the prayer for bail. Be that as it may, I am inclined to admit the petitioners on anticipatory bail. The above named petitioners are directed to surrender in the Court below within four weeks from the date of this order and in the event of their arrest or surrender, the Court below shall enlarge the above named petitioners on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ranchi, in connection with Sikidiri P.S. Case No. 11 of 2017, corresponding to G.R. No. 1206 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and subject to the further condition that petitioners shall deposit Rs. 32,000/- each before the court below at the time of surrender, which shall be subject to the result of the case and will not prejudice the case of the petitioner during trial.
