The petitioners are apprehending their arrest in connection with Ramgarh P.S. Case No. 70/2017 corresponding to G.R. No. 273/2017, the case registered under Sections 379/411 of the Indian Penal Code and under Section 54 of JMMC Rule 30 and under Section 04 of Jharkhand Mines and Minerals (Development) and Regulation) Act. 1957 and under Section 21 of Air Pollution and Control Act 1981.

Learned counsel for the petitioner submitted that the petitioners are innocent and they have falsely been implicated in this case. It is further submitted that as per FIR it appears that the seized stones are not stolen property rather the same has been seized under lease hold area.

Learned A.P.P opposed the prayer for bail.

Considering the fact and circumstances of the case, the above named petitioners are directed to surrender in the Court below within four weeks from the date of this order and in the event of their arrest or surrender, the Court below shall enlarge the above named petitioners, on bail, on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of C.JM.,Ramgarh, in connection with Ramgarh P.S. Case No. 70/2017 corresponding to G.R. No. 273/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C., and subject to the further condition that on the date of surrender petitioners shall deposit Rs. 6,000/- each in the Court below, which shall be subject to the result of the case.
