2 20-08-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Complaint Case No. 06 of 2018, registered under Sections 44, 41(2) of the Water (Prevention and Control of Pollution) Act and Section 15 of the Environment (Protection) Act.
The accusation is of running of 10 bed hospital by the petitioner and his wife Rekha Singh in the name of M/s Rekha Singh Memorial Hospital at Kshatriya Nagar, Aurangabad without taking the permission of Bihar State Pollution Control Board.
Learned counsel for the petitioner submits that, in Patna High Court CR. MISC. No.51704 of 2019(2) dt.20-08-2019 2/2 fact, petitioner after developing the infrastructure for running of hospital gave an application for provisional registration of clinical establishment to the concerned department, but till date the permission was not received for running the hospital. In the meantime, on inspection the present case has been lodged.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Aurangabad in connection with Complaint Case No. 06 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
