Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner has been made accused for the offence under Section 379 of the Indian Penal Code, u/s 33 of the I.F. Act and u/ss 4 and 21 of the Pollution Control Act, in connection with Barkatha P.S. Case No.47 of 2013, corresponding to G.R. No.704 of 2013.

There is allegation against the petitioner of running a stone crusher without taking valid license and NOC.

In the facts and circumstances of the case, I am inclined to release the petitioner on bail. Accordingly, the petitioner Jakir Mian is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of Smt. Garima Mishra, learned Judicial Magistrate, 1st Class, Hazaribagh, or her successor, in connection with Barkatha P.S. Case No.47 of 2013, corresponding to G.R. No.704 of 2013.
