4 24-06-2019 Heard the parties.

This application is for grant of regular bail in connection with Barun P.S.Case No.45 of 2019 for the offences under Sections 379, 411, 420/34 of the Indian Penal Code and 4/40 BMMCR and 15 of Pollution Act.

Allegation against the petitioner is of carrying sands without having licence of challan.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted, he has no criminal antecedent and other co-accused persons have been granted privilege of anticipatory bail.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts Patna High Court CR. MISC. No.23433 of 2019(4) dt.24-06-2019 2/2 and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered on its own merit without being prejudiced by the order of this Court and if possible to be disposed of on the same day.

With the above direction, this application is dismissed.
