As directed by this Court, Mr. Akhil Simlote appears for the respondent Nos.1 and 2. Under challenge is the order dated 09.06.2016 passed by the Rajasthan State Pollution Control Board (hereinafter the Board), which is appealable under Section 31 of the Air (Prevention and Control of Pollution) Act, 1981 and under Section 28 of the Water (Prevention and Control of Pollution) Act, 1974. The petitioner having an alternative remedy, this petition cannot be entertained. The petition is accordingly dismissed as non-maintainable. Stay application also stands dismissed.
The petitioner shall however be at liberty to take its statutory remedy as available in the law. The Appellate Authority is directed to dispose of the appeal within a period of four weeks of its filing.
