                             JUDGMENT

Aggrieved by Ext.P8 notice issued by the Pollution Control Board, this writ petition has been filed. The petitioner challenges the same in the light of the fact that the consent for operation of the Industrial unit has been withheld for complying certain directions. By order dated 3/3/2010 this Court directed the petitioner to file an appeal before the Air and Water Appellate Tribunal under Section 31 of the Air (Prevention and Control of Pollution) Act, 1981.

2. The learned counsel for the petitioner submitted that he has filed an appeal which is numbered as 2/2010 and the same is posted on 25/3/2010 for hearing.

3. In the light of the above, the said Authority will take a decision in the appeal after hearing the petitioner. Till a decision is taken in the appeal and communicated to the petitioner, the status-quo as on today will continue.

The writ petition is disposed of as above.
