The writ petition has been filed way back in the year 2001 praying for prevention and/or control of air pollution in the locality and also for praying to take appropriate measure by the West Bengal Pollution Control Board in terms of provision of Section 17 of the Air Prevention and Control of Pollution Act, 1981.
The record of proceedings of the West Bengal Pollution Control Board, which has been filed in court today, indicates that the Pollution Control Board had taken certain steps in the matter and directed certain improvements.
In case, any grievance still subsists and the pollution is being caused in the locality, the petitioners are at liberty to approach the appropriate authority by way of filing a representation. In the event, any representation is filed by the petitioners, the same shall be considered objectively after an inspection to be made by the West Bengal Pollution Control Board, which shall pass an appropriate order within a period of three months from the date of filing the representation after hearing affected person.
With the aforesaid observations, the writ dns & skc petition is disposed of without, however, any order as to costs.
