: Bail application filed by petitioner Ramesh Prasad is moved by Sri. Vijay Shankar Prasad and opposed by Sri. S.P. Jha , learned Additional P.P.

This is a case under sections 379/34 of the IPC, 14 of the Pollution Act and 48, 53 and 54 of Jharkhand Minor Minerals Concession Rule 2004. It appears that the co-accused have been granted bail by the court below and bail prayer of the petitioner rejected because of his antecedent. However, it is stated at paragraph no. 13 of the bail application that petitioner involved in only one case under section 307 of the IPC which resulted in his acquittal.

Considering the aforesaid facts and circumstance, I allow this application and direct the court below to enlarge the petitioner, above named, on bail on furnishing bail bond of Rs. 10,000/(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Latehar in connection with Latehar P.S. Case No. 35 of 2012 ( G.R. No. 169 of 2012). ( Prashant Kumar,J.) Sharda/-
