Apprehending their arrest in connection with Mandu (Kuju) PS Case No. 104 of 2015 registered under sections 379/411/120B of the Indian Penal Code, section 21 of the MMRD Act, sections 21/31 of the Air Pollution Act and section 30 (ii) of the Coal Mines Act, both the petitioners pray for grant of anticipatory bail .
Heard the learned counsel for the parties.
It appears from the order dated 9.6.2015 that a direction was given to the investigating officer to submit a report and from the report submitted by the investigating officer, it appears that the coal in question had been validly purchased by the petitioners.
Learned counsel for the State though opposed the prayer, but submitted that the report submitted by the investigating officer is in favour of the petitioners.
In view of the submissions of the learned counsel and the aforesaid report, both the petitioners Dinesh Kumar and Aditya Mishra, in the event of their arrest or surrender before the court below within a period of two weeks positively from the date of this order, shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ramgarh, in connection with Mandu (Kuju) PS Case No. 104 of 2015 (GR No. 903 of 2015), subject to the conditions laid down under section 438(2) Cr.P.C Ambastha/- ( R.N.Verma, J. )
