Against the order impugned in this petition passed by the Pollution Control Board there is an alternative remedy of filing a statutory appeal under Section 31 of the Air (Prevention and Control of Pollution) Act, 1981.

Since there exists a statutory alternative remedy, the petition filed challenging the said order is not liable to be entertained and accordingly stands dismissed. However, in case the appeal is filed within one week from today we hope and trust that the Appellate Authority shall proceed to consider and decide the same as expeditiously as possible but in any case not later than six weeks from the date of filing of the appeal.
